originalism is fascist

I don’t need to wait for Alito to explain his dissent in the case of deportations under the Alien Enemies Act. His originalism means he’ll say that an act from 1798 is so close to 1776 that it might as well be Original and therefore it’s fine.

Alito’s bullshit Originalism is a morally bankrupt view that allows him to justify all manner of discrimination. Expect to see his full throated approval of cases that deny women and Black people their constitutional rights.

He’ll just shrug and say, what can I do when the founders wrote a constitution in which women and Black people did not have the same constitutional rights as white men.
